Buffalo Warranty Statement For Purchaser in Australia

Buffalo Inc. (“Buffalo”) warrants to the purchaser that Buffalo products shall be free from defects in materials and workmanship for a period of one (1), two (2) or three (3) year (as stated in the description on the product package or other attachment) from the date of purchase by purchaser. This warranty does not cover non-Buffalo installed components. If the Buffalo product malfunctions during the warranty period, Buffalo will, at its discretion, repair or replace the product at no charge, provided the product has not been subjected to misuse, abuse or non-Buffalo authorized alterations, modifications or repairs. Please note that goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods. If Buffalo determines that it is unable to either repair or replace purchaser’s product, then subject to purchaser’s rights under the Australian Consumer Law referred to below, purchaser’s sole remedy under this warranty is to return the product to purchaser’s place of purchase or to Buffalo for a refund of purchaser’s purchase price.

When returning a product, you must include purchaser’s original proof of purchase. Return requests under this warranty will not be processed without proof of purchase. This does not affect purchaser’s statutory rights. Purchaser is responsible for bearing any and all costs and expenses for returning the product to Buffalo for repair or replacement as mentioned above.

This Warranty gives purchaser specific legal rights. Purchaser also has other rights at law, including under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You (purchaser) are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You (purchaser) are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. The benefits provided under this warranty are in addition to and do not affect purchaser’s statutory rights under the Australian Consumer Law or other rights at law.

Buffalo products are restricted to the country/region of purchase.

Subject to purchaser’s non-excludable rights under the Australian Consumer Law and to the extent permitted by law
• Buffalo excludes any liability to the purchaser or any third party for any loss or damage, whether in negligence or otherwise, including any lost profits, lost savings or other incidental or consequential damages arising out of the use of, or inability to use, the Buffalo products.
• In no event shall Buffalo’s liability exceed the price paid for the product from direct, indirect, special, incidental, or consequential damages resulting from the use of the product, its accompanying software, or its documentation.

Please note: all warranties, conditions or guarantees that are not guaranteed by the Australian Consumer Law (or other relevant law) for the Buffalo product line and which are not expressly included in this warranty, are excluded.

This warranty does not cover stored data. Buffalo shall have no responsibility for any such data and shall have no liability arising out of any damage to or loss of such data stored in the product, resulting from repair under this warranty and/or any use by purchaser while the product is in the purchaser’s possession.
